Privacy Policy

Effective and Last Updated: September 17, 2026

Apex Lending Partners (“Apex,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you visit apexlendingpartners.com (the “Site”), request information, submit or sign a commercial-financing application, provide supporting documents, communicate with us, or otherwise use our services.

Commercial-purpose services only. Apex provides commercial-financing brokerage and referral services to businesses. Apex is not a consumer lender and does not offer financing for personal, family, or household purposes. Even so, we may collect personal information about business owners, guarantors, representatives, and other individuals associated with a business applicant.

1. Scope and Acceptance

This Policy applies to information handled by or on behalf of Apex through the Site, telephone, email, text messaging, electronic-signature platforms, application workflows, service providers, funding providers, and related business operations. By providing information to Apex, you acknowledge the practices described in this Policy. Additional notices or consents may apply to particular products, communications, credit inquiries, or transactions.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

  • Business information: legal and trade names, entity type, industry, employer identification number, business address, formation date, ownership structure, revenue, funding needs, intended use of funds, existing obligations, and other operational or underwriting information.
  • Identifiers and contact information: name, title, home or business address, email address, telephone number, date of birth, IP address, device identifiers, and similar identifiers.
  • Sensitive personal information: Social Security number, taxpayer or government identifiers, identity-verification information, financial-account information, and authentication or security information.
  • Financial and credit information: business bank statements, transaction histories, balances, revenue, financing history, credit information, credit reports or scores where lawfully obtained, and information concerning current or prior financing providers.
  • Application and transaction information: application responses, supporting documents, underwriting materials, offers, approvals, denials, funding-provider decisions, contracts, electronic signatures, audit trails, and records of the application process.
  • Communications: emails, text messages, telephone calls, chat messages, support requests, call recordings or transcripts where permitted, consent records, and marketing preferences.
  • Internet and device activity: browser and device type, operating system, pages viewed, links clicked, referring URLs, approximate location derived from IP address, cookie identifiers, advertising identifiers, and interaction data.
  • Inferences and risk indicators: fraud, identity, eligibility, security, and underwriting-related indicators derived from the information described above.

Please do not provide personal information about another person unless you are authorized to do so and have provided any notice or obtained any consent required by law.

3. Sources of Information

We may obtain information:

  • directly from you or your business;
  • from co-owners, guarantors, authorized representatives, accountants, brokers, or agents;
  • from funding providers, underwriters, banks, payment processors, credit reporting agencies, identity-verification services, fraud-prevention services, and other transaction participants;
  • from licensed data providers, lead generators, marketing partners, business directories, government records, and other public sources; and
  • automatically through cookies, pixels, analytics tools, server logs, and similar technologies.

Third parties that provide information to Apex are responsible for having lawful authority to collect and share it. If you believe information was provided improperly, contact us at info@apexlendingpartners.com.

4. How We Use Information

We may use information to:

  • receive, process, verify, and evaluate commercial-financing inquiries and applications;
  • confirm identity, authority, ownership, and application accuracy;
  • obtain credit or other reports when authorized and permitted by law;
  • match applicants with potential funding providers and present financing options;
  • facilitate underwriting, due diligence, document collection, electronic signatures, closing, funding, servicing, and follow-up;
  • communicate about inquiries, applications, offers, documents, security, and customer support;
  • detect, investigate, and prevent fraud, misuse, security incidents, and illegal activity;
  • operate, secure, debug, analyze, and improve our Site, services, systems, and business processes;
  • maintain records, enforce agreements, resolve disputes, and protect legal rights;
  • comply with applicable laws, lawful process, regulatory obligations, and funding-provider requirements; and
  • conduct business-to-business marketing where permitted and honor opt-out and suppression requests.

We do not use Social Security numbers, bank statements, or financial-account information for targeted advertising.

5. Credit Reports and Verification

When you submit an application and provide the required authorization, Apex and participating funding providers may verify information and obtain business or personal credit reports, background information, bank-account information, and other reports for a permissible purpose related to the transaction you initiated. A privacy policy alone does not create credit-report authorization; any required authorization is presented separately in the application or transaction documents.

6. How We Disclose Information

We may disclose information, including application documents and sensitive information where reasonably necessary, to:

  • Funding providers and transaction participants that evaluate, offer, fund, purchase, participate in, service, or otherwise support a commercial-financing transaction;
  • Credit, identity, banking, and fraud services used to verify identity, ownership, financial information, creditworthiness, or transaction legitimacy;
  • Service providers supporting secure hosting and storage, malware scanning, information security, electronic signatures, communications, customer support, analytics, document generation, and business operations;
  • Professional advisors such as attorneys, accountants, auditors, insurers, and compliance consultants;
  • Governmental, regulatory, or legal authorities when required by law, subpoena, court order, or other lawful process, or when reasonably necessary to protect rights, safety, or security;
  • Corporate transaction parties in connection with a proposed or completed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to appropriate confidentiality protections; and
  • Other parties at your direction or with your consent.

Funding providers and other independent third parties may have their own privacy practices. Their handling of information is governed by their policies and applicable law.

7. Cookies, Analytics, and Advertising

We and our analytics or advertising partners may use cookies, pixels, tags, and similar technologies to operate the Site, remember preferences, measure performance, detect fraud, and understand or improve marketing. These technologies may collect device identifiers and Site activity over time and across websites.

We do not sell personal information for cash. Some state laws may characterize certain advertising or analytics disclosures as a “sale,” “sharing,” or “targeted advertising.” Where applicable, you may request to opt out by emailing info@apexlendingpartners.com with the subject “Privacy Opt-Out Request.” You may also use browser controls to restrict cookies. Blocking cookies may affect Site functionality.

We do not knowingly sell or share sensitive personal information or personal information concerning anyone under 18 for targeted advertising.

8. Communications and Marketing Choices

  • Application communications: We may contact you by telephone, email, or text about an inquiry or application you initiated, document requests, transaction status, fraud prevention, security, and customer service.
  • Email marketing: Marketing emails include an opt-out method. You may unsubscribe using that method or contact us. Transactional or relationship messages may continue where permitted.
  • Text messaging: Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for assistance. Marketing consent is not a condition of obtaining services.
  • Calls and automated technologies: Where permitted and with any consent required by law, calls may use automated dialing, prerecorded or artificial voice, call-routing, or artificial-intelligence technologies. You may revoke marketing consent through a reasonable method.

See our SMS/Text Messaging Terms for additional information.

9. Data Retention and Secure Disposal

We retain information only for as long as reasonably necessary for the purposes described in this Policy, including processing and servicing transactions, maintaining business and legal records, preventing fraud, honoring suppression requests, resolving disputes, enforcing agreements, and satisfying legal, regulatory, contractual, audit, insurance, or funding-provider requirements.

Our retention decisions consider the sensitivity of the information, the status of the application or transaction, the date of our most recent use of the information to serve the applicant or business, applicable limitation periods, and whether a legal hold or legitimate business need applies. Subject to those exceptions, customer information covered by applicable financial-data safeguarding requirements is scheduled for secure disposal no later than two years after its most recent use to serve the customer. Certain funded-transaction, accounting, compliance, fraud-prevention, consent, and dispute records may be retained longer when reasonably required.

When information is no longer required, we take reasonable steps to delete, destroy, de-identify, or render it unreadable. Backup copies may remain for a limited period until overwritten through ordinary backup cycles.

10. Information Security

We maintain administrative, technical, and physical safeguards designed to protect information based on its sensitivity and the nature of our operations. Depending on the system and risk, safeguards may include encryption in transit and at rest, access controls, multifactor authentication, private document storage, malware scanning, activity logging, vendor oversight, employee procedures, risk assessments, incident-response processes, and secure disposal.

No method of transmission or storage is completely secure. You are responsible for using secure devices, protecting your credentials, and notifying us promptly if you suspect unauthorized activity. Do not send unencrypted bank statements, Social Security numbers, or similar sensitive information through ordinary email unless specifically instructed to use an approved secure method.

11. Privacy Rights and Requests

Depending on your state of residence and whether a particular privacy law applies, you may have the right to request access to, correction of, or deletion of personal information; obtain a portable copy; confirm processing; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive personal information; or appeal a decision concerning a request.

Submit a request by emailing info@apexlendingpartners.com with the subject “Privacy Rights Request” or by writing to the address below. Describe your request and the state in which you reside. We may verify your identity and authority before responding. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct identity confirmation.

Rights are subject to exceptions. For example, we may retain or decline to delete information needed to complete a transaction, detect fraud, maintain security, comply with law, establish or defend legal claims, honor an opt-out, or meet contractual and recordkeeping obligations. We will not unlawfully discriminate against you for exercising an applicable privacy right.

12. Supplemental Notice for California Residents

If the California Consumer Privacy Act, as amended (“CCPA”), applies to Apex or to particular information, California residents may have the rights described above. During the preceding 12 months, Apex may have collected the categories described in Section 2; obtained them from the sources described in Section 3; used them for the purposes described in Sections 4 and 5; and disclosed them to the categories of recipients described in Section 6.

The categories may include identifiers; customer records; protected-classification information when voluntarily provided or lawfully obtained; commercial information; internet activity; geolocation information; audio or electronic information; professional or employment-related information; inferences; and sensitive personal information such as government identifiers, account information, and precise identity or financial-verification data. We use and disclose sensitive personal information only for application processing, transaction support, security, fraud prevention, compliance, and other permitted business purposes—not to infer characteristics for advertising.

Apex does not knowingly sell personal information for money. As explained in Section 7, certain cookie-based advertising activity may be treated as sale or sharing under California law. Requests to know, delete, correct, limit, or opt out may be submitted using the methods in Section 11. We do not knowingly collect, sell, or share personal information of individuals under 18.

13. Children’s Privacy

Our services are intended for businesses and adults authorized to act for them. We do not knowingly collect personal information from children under 13, and we do not knowingly permit anyone under 18 to submit a financing application.

14. Third-Party Sites and Services

The Site may link to or integrate third-party services. Apex is not responsible for the privacy, security, availability, or content of independent third parties. Review their policies before providing information.

15. U.S. Processing and International Users

Apex’s services are directed to U.S. businesses. Information may be processed and stored in the United States, where privacy laws may differ from those in your location.

16. Changes to This Policy

We may update this Policy to reflect changes in law, technology, vendors, or business practices. We will post the updated version with a revised effective date. Material changes will apply prospectively to the extent required by law, and we may provide additional notice when appropriate.
